These Terms & Conditions apply to the use of the Hot Pottery website and to purchases made from us.

Please read them carefully before placing an order.

These Terms & Conditions apply alongside our other policies, including our:

  • Returns Policy
  • Privacy Policy
  • Cookie Policy and cookie settings
  • any specific promotional terms displayed on our website from time to time

If there is any conflict between these Terms & Conditions and a specific promotion or offer, the specific terms of that promotion or offer will apply to the extent of the conflict.

Nothing in these Terms & Conditions affects your statutory rights.

2. Using our website

You may use our website for lawful, personal and non-commercial purposes.

You must not misuse our website, attempt to gain unauthorised access to it or its systems, knowingly introduce malicious or harmful software, or use the website in a way that may damage, disable or interfere with its operation or another person’s use of it.

We may update, change, suspend or withdraw parts of the website from time to time.

Although we aim to keep the website available and accurate, we cannot guarantee that it will always be uninterrupted, error-free or available.

3. Customer accounts

You may be able to create or use a customer account when shopping with us.

You are responsible for ensuring that the information you provide to us is accurate and up to date and for keeping any account access details secure.

We may suspend or close an account where we reasonably believe it is being misused, used fraudulently or in breach of these Terms & Conditions.

You may ask us to close your customer account at any time.

4. Our products

We take reasonable care to ensure that product descriptions, photographs, measurements and other information on our website are accurate.

However, images are provided for illustrative purposes and the appearance of products may vary slightly from the images displayed on your screen.

In particular, colours may appear differently depending on your device, display settings and lighting.

Where products are handmade, hand-finished or produced using materials that naturally vary, there may also be reasonable variations between individual pieces. These characteristics do not necessarily constitute a fault.

Nothing in this section limits your statutory rights where goods are faulty, not as described or otherwise do not conform to your contract.

We may make minor changes to products where necessary to comply with applicable laws or regulatory requirements, provided those changes do not materially alter the product you ordered.

5. Placing an order

When you place an order through our website, you are offering to purchase the products in your basket subject to these Terms & Conditions.

You are responsible for checking your order, delivery information and contact details before completing checkout.

After you place your order, we will normally send you an email confirming that we have received it.

This acknowledgement does not necessarily mean that we have accepted your order.

Unless we tell you otherwise, a contract between you and Hot Pottery is formed when we dispatch the products and send you confirmation that they have been dispatched.

We may refuse or cancel an order before dispatch where there is a reasonable reason to do so, including where:

  • a product is unavailable;
  • we cannot obtain authorisation for payment;
  • there has been an obvious pricing or product-description error;
  • we reasonably suspect fraud or unauthorised activity;
  • delivery is not possible to the address provided; or
  • an order breaches a purchasing restriction or promotional condition clearly communicated to you.

If we cancel an order after taking payment, we will refund the amount paid for the cancelled products.

We may reasonably limit the quantity of products available to an individual customer, particularly where products are limited edition, subject to a promotion or where we reasonably suspect purchases are being made for unauthorised resale.

6. Prices and payment

Prices are displayed in pounds sterling unless stated otherwise and include UK VAT where applicable.

Delivery charges, where applicable, will be displayed separately before you complete your order.

We may change our prices at any time, but a change will not affect an order that has already been accepted by us.

We take reasonable care to ensure prices shown on our website are correct.

If we discover an obvious and unmistakable pricing error which could reasonably have been recognised as an error, we may cancel the affected order. If payment has already been taken, we will refund you.

Payment methods available to you will be displayed at checkout.

Your payment method may be authorised or charged when you place your order.

Discount codes, promotional codes and vouchers are subject to any additional conditions communicated with them and must be applied before completing checkout.

Unless specifically stated otherwise, promotional codes cannot be exchanged for cash and may not be combined with other offers.

7. Klarna

We offer Klarna as a payment method to eligible customers in the UK.

When you choose Klarna at checkout, your personal data and order information may be shared with Klarna so that Klarna can assess your eligibility for its payment options and tailor those payment options to you.

The use of this information is governed by Klarna’s Privacy Notice.

The Klarna payment options available to you will be displayed at checkout and are subject to eligibility, status and Klarna’s terms and conditions.

Klarna’s Pay in 3 and Pay in 30 days are credit products available to permanent UK residents aged 18+, subject to status and Klarna’s terms and conditions.

Questions relating to your Klarna account, payment schedule, eligibility or credit agreement should be directed to Klarna.

Questions relating to your Hot Pottery order, delivery, returns or products should be directed to us.

8. Delivery

Available delivery options, charges and estimated delivery times will be displayed during checkout or otherwise communicated to you before your order is completed.

We will deliver your order to the delivery address you provide.

Please check your delivery address carefully before completing your order.

If you contact us promptly after ordering, we will try to assist with an address change, but we cannot guarantee that an address can be changed once an order has entered our fulfilment or delivery process.

Unless a different delivery period has been agreed with you, we will deliver your goods without undue delay and within 30 days of the contract being formed.

For pre-orders or other products with a later estimated delivery date, a delivery period longer than 30 days may apply where this has been clearly communicated and agreed before you purchase.

Estimated delivery dates are estimates unless we expressly agree that a particular date is essential.

If products in your order become temporarily unavailable, we may contact you to offer separate delivery. You do not have to accept split delivery.

Risk in the products passes to you when the goods are physically received by you, or by another person you nominate to receive them on your behalf, other than a carrier arranged by us.

Ownership of the products passes to you once we have received payment in full.

If delivery cannot be completed, the courier may follow its normal re-delivery, collection or safe-place procedures.

Where a delivery fails because you supplied an incorrect address or failed to collect or accept a delivery after reasonable attempts have been made, we may charge reasonable additional costs actually incurred in arranging re-delivery, where permitted by law.

9. Pre-orders

Products described as pre-orders are not immediately available for dispatch.

The expected availability or delivery period will be stated on the relevant product page or otherwise communicated to you before purchase.

Pre-order dates are estimates and may occasionally change for reasons outside our reasonable control.

If there is a material delay, we will let you know and, where applicable, give you the option to continue waiting or cancel the affected order for a refund.

Your statutory cancellation and consumer rights are not affected.

10. Your right to cancel an online order

If you are a consumer purchasing online, you normally have a legal right to change your mind and cancel your contract within 14 days after receiving your goods, without giving a reason.

Where a single order is delivered in separate deliveries, the cancellation period normally runs from the day after you receive the final item or delivery forming part of that order.

To exercise your right to cancel, you must clearly tell us that you wish to cancel within the applicable cancellation period.

After telling us that you wish to cancel, you must return the goods to us within a further 14 days.

Unless the goods are faulty, damaged or incorrect, you are responsible for the cost of returning unwanted goods to us.

Certain goods may be excluded from the statutory cancellation right where an exemption under consumer law applies, including certain personalised or made-to-order products.

Where a product is subject to an applicable restriction, we will make this clear where appropriate.

11. Refunds following cancellation

If you validly cancel an online order within your statutory cancellation period, we will refund the amount paid for the goods being returned.

If you cancel and return your entire order, we will also refund the cost of our standard delivery service where you paid for delivery.

If you selected a more expensive delivery option, such as express delivery, we are not required to refund the additional amount above the cost of our standard delivery service.

We may make an appropriate deduction from a refund where goods have been handled beyond what is reasonably necessary to establish their nature, characteristics and functionality and that handling has reduced their value.

We will process refunds without undue delay and within the time limits required by law.

Where goods must be returned, we may withhold the refund until we have received the goods back or you provide evidence that you have sent them back, whichever occurs first.

Refunds will normally be made to the original payment method.

12. Sale and promotional products

Products purchased during a sale or promotion have the same statutory consumer rights as products purchased at full price.

If you are entitled to a refund for a discounted item, the refund will normally be based on the amount you actually paid for that item.

Any additional promotional conditions will be made clear when the promotion is offered.

Nothing in any promotion limits your statutory rights.

13. Sets and bundles

Where products are sold together as a single set or bundle and you exercise a change-of-mind cancellation right in respect of that set or bundle, we may require the complete set or bundle to be returned.

This does not affect your statutory rights where an individual item within a set or bundle is faulty, damaged, not as described or otherwise does not conform to the contract.

14. Free gifts and promotions

From time to time, an order may qualify for a free gift, discount or other promotional benefit.

Promotions may be subject to additional eligibility requirements communicated at the time of the promotion.

If an order is cancelled or returned and, as a result, no longer meets the qualifying conditions for a free gift or promotional benefit, we may require any free gift to be returned.

If a free gift is not returned when reasonably required, or you choose to retain it, we may make a reasonable adjustment to the refund where the terms of the promotion clearly allowed for this and the law permits us to do so.

Your statutory rights are not affected.

15. Faulty, damaged or incorrect goods

We have a legal duty to supply goods that conform to the contract.

Goods must be of satisfactory quality, fit for their intended purpose and as described.

If goods are faulty, damaged, not as described or otherwise do not conform to the contract, you may have statutory rights including a right to reject the goods for a refund and, depending on the circumstances and timing, rights to repair, replacement, a price reduction or a refund.

Your statutory rights under the Consumer Rights Act 2015 are not affected by these Terms & Conditions.

If you receive a damaged, faulty or incorrect item, please contact us at hello@hotpottery.co.uk as soon as possible.

For transit damage, we ask that you contact us ideally within 24 hours where possible because this helps us investigate the damage with our delivery partner. However, failure to contact us within 24 hours does not remove or reduce your statutory rights.

We may ask you to provide:

  • your order number;
  • your name and email address;
  • a description of the issue;
  • photographs of the product; and
  • photographs of the internal and external packaging where relevant.

Please retain the product and packaging until we have responded, where reasonably possible.

Where a return is required because goods are faulty, damaged or incorrectly supplied, we will cover the reasonable return cost or arrange collection where appropriate.

Where there is any conflict between the Returns Policy and your statutory rights, your statutory rights will take precedence.

17. Intellectual property

All intellectual property rights in our website and its content, including text, photography, graphics, branding, illustrations, designs, video and other materials, belong to Hot Pottery or our licensors unless stated otherwise.

You may view and use our website for personal and non-commercial purposes.

You may not reproduce, distribute, modify, commercially exploit or otherwise use our website content without our prior written permission, except where permitted by law.

18. Our liability

Nothing in these Terms & Conditions excludes or limits any liability that cannot lawfully be excluded or limited, including liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation; or
  • breach of your statutory consumer rights.

If we fail to comply with these Terms & Conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill.

Loss or damage is foreseeable where it is obvious that it will happen or where, at the time the contract was entered into, both you and we knew it might happen.

We supply products to consumers for domestic and private use.

Unless we have expressly agreed otherwise, we are not responsible for business losses, including loss of profit, loss of business, loss of revenue, business interruption or loss of business opportunity arising from products purchased primarily for commercial purposes.

Nothing in this section affects your statutory rights.

19. Events outside our reasonable control

We will not be responsible for delay or failure to perform our obligations where this is caused by an event outside our reasonable control.

Examples may include severe weather, natural disasters, strikes, transport disruption, failures of utilities or telecommunications networks, government action, war, civil disturbance or other events that we could not reasonably prevent.

Where such an event affects your order, we will take reasonable steps to minimise the impact and will contact you where appropriate.

Your legal rights in relation to delayed or undelivered goods remain unaffected.

We process personal information in accordance with applicable data-protection law and our Privacy Policy.

Our Privacy Policy explains what personal information we collect, why we use it, the lawful bases on which we process it, who we may share it with and the rights available to you.

21. Third-party services and websites

Our website may contain links to third-party websites or use services provided by third parties, including payment providers and delivery providers.

We are not responsible for the content or operation of third-party websites that we do not control.

Where a third party provides part of a service connected with your order, your rights against Hot Pottery under applicable consumer law are not affected.

22. Changes to these Terms & Conditions

We may update these Terms & Conditions from time to time, including to reflect changes to our business, our website, our products or applicable law.

The Terms & Conditions applicable to your purchase will generally be those in force when you place your order.

Changes made after an order has been accepted will not retrospectively alter the terms of that contract unless required by law or agreed with you.

The latest version of these Terms & Conditions will be available on our website.

24. Other important terms

If any provision of these Terms & Conditions is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

If we delay exercising a right under these Terms & Conditions, that does not mean we have waived that right.

We may transfer our rights and obligations under a contract to another organisation where permitted by law. If this happens in a way that materially affects you, we will let you know.

You may only transfer your rights or obligations under a contract where we agree or where the law permits you to do so.

A contract is between you and Hot Pottery. Except where applicable law provides otherwise, no third party has a right to enforce its terms.

25. Governing law and disputes

These Terms & Conditions and contracts between you and Hot Pottery are governed by English law.

If you are a consumer resident elsewhere, this does not deprive you of any mandatory consumer protections that apply in the country where you normally live.

If you live in England or Wales, the courts of England and Wales will normally have jurisdiction.

If you live in Scotland, Northern Ireland or another jurisdiction, you may also have rights to bring proceedings in the courts applicable to where you live.

Nothing in this section restricts any mandatory rights available to you under applicable consumer law.

Order (the “Delivery Address”). If you make an error when specifying a Delivery Address for an Order, we will not be able to change it for that Order, but Registered Users can easily change it via their “My Account” pages of this Website for future Orders. However, we have the right to refuse to deliver to certain areas from time to time and if your proposed Delivery Address is within such an area, we reserve the right to not to accept the Order. 

Delivery of the Ordered Products (“Delivery”) will occur when the Order Products are delivered to the Delivery Address.

Hot Pottery’s responsibility for the Ordered Products ceases from the point of Delivery and you be responsible for the Ordered Products from that time.

It is your responsibility to make sure that Delivery can be achieved and that a person is available at the Delivery Address. If no one is available at your Delivery Address to take delivery of the Ordered Products, we may cancel the Contract and paragraph 17 will apply.

If you fail to make sure that Delivery can be achieved in accordance with paragraph 9.6, we may elect not to cancel the Contract but instead to attempt to re-deliver the Ordered Products to you or to store the Ordered Products for collection by you. If, as a result, we incur additional delivery or storage costs, you will be liable to pay us the amount of such additional delivery or storage costs.

You will own the Ordered Products once we have received payment in full for the Ordered Products.

If an Order is placed and some of the Ordered Products are unavailable, we may send the available Ordered Products to you with the unavailable Ordered Products to follow at a later date. We will always notify you if this is the case, and you have the right to refuse this option.

If Ordered Products are Delivered but are of bad quality or (without any agreement pursuant to paragraph 9.9) are incomplete, then you must notify us immediately when you receive the Ordered Products.

 

10. Price and Payment

The price payable for the Ordered Products shall be as shown on this Website from time to time and shall be in pounds sterling (GBP), although please see paragraphs 11.5 and 11.6 for what happens if we discover an error in the price of any Ordered Product. Prices advertised on this Website include UK VAT at the relevant rate chargeable for the time being, and include delivery charges.

We can change the prices on this Website at any time without notice, but changes will not affect Orders which we have already been placed in accordance with paragraph 8.2. However, if the rate of VAT changes and such change becomes effective after the date of your Order, we will adjust the rate of VAT you pay unless you have already paid for the Ordered Products in full before the change in VAT takes effect.

We accept payment by debit card & credit card. We accept the following cards: Visa, MasterCard and American Express.

You must pay for all of the Ordered Products (including all applicable delivery charges and VAT), and we will charge the payment method (chosen by you to pay for your Ordered Products during the Checkout process), when you place an Order.

If we accept and process your Order where there is a pricing error that is obvious and unmistakable and which could reasonably have been recognised by you as a mispricing, we may end the Contract, refund to you any sums you have paid under the Contract and require the return of any of Our Products provided to you.

If you wish to apply a voucher code to an Order, you must enter the relevant code, when prompted, during the Checkout process. Only one voucher code can be used per Order and use of each voucher code is subject to the provisions of Voucher and Referral Scheme Rules.

 

11. Your right to cancel the contract (EEA customers only)

If you are a consumer in the European Economic Area (“EEA”), you have a legal right to cancel a Contract if you change your mind until 14 days after you receive (or someone you nominate receives) the Ordered Products, unless the Ordered Products are split into several deliveries over different days in which case you will have until 14 days after the day you receive (or someone you nominate receives) the last delivery.

If you wish to cancel a Contract under paragraph 12.1, you need to communicate this to us no later than 24hrs before a renewal is due and within the timescale set out in paragraph 12.1. The easiest way to do this is to contact us by email at hello@hotpottery.co.uk

If you cancel a Contract under paragraph 12.1 after the Ordered Products have been dispatched to you, you must return them to us. You must send off the Ordered Products within 14 days of telling us that you wish to cancel the Contract. We will pay the costs of your returns if you use our free returns service in accordance with our Returns Policy, but if you do not use this service in accordance with our instructions then you will be responsible for the cost of returning Ordered Products to us. Please see our Returns Policy for further information about how to return Ordered Products to us.

 

12. Your right for a refund (EEA customers only)

If you are a consumer in the EEA and you cancel your Contract under clause 12.1, we will:

refund you the price you paid for the Ordered Products. However, please note that we may reduce your refund to reflect any reduction in the value of the Ordered Products, if this has been caused by your handling them in a way which would not be permitted in a shop. If we refund you the price paid before we are able to inspect the Ordered Products and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount; and

refund any charges you have paid for delivery of the Ordered Products to you, although the maximum refund for delivery costs will be the least expensive delivery method we offer to your delivery destination; and

make any refunds due to you by the method you used by you for payment:

14 days after the day on which we receive the Ordered Products back from you or, if earlier, the day on which you provide us with evidence that you have sent the Ordered Products back to us; or

14 days after you inform us of your decision to cancel the Contract

13. Returns and refunds on promotional offers

If you return Ordered Product and are entitled to a refund, you will be refunded the price such Ordered Product which it was at the time of the Order for example, if the Ordered Product was offered at a reduced price, you will be refunded the reduced price. Your statutory rights will not be affected as a result of this.

Ordered Products that form part of a set (past bowl, side plate and dinner plate) of Our Products can only be returned and refunded where the complete set of Ordered Products is returned. Individual Ordered Products making up part of such set may not be returned and refunded separately.

Ordered Products purchased during a sales promotions can only be returned if unopened and returned within 14 days of Delivery.

Customers will be required to cover the cost of returning unwanted orders. Full refunds will be processed for the amounts paid to Hot Pottery.

 

14. Excluded services

When using this Website, an internet connection is required to gain access to this Website. If any other costs are caused as a result of internet connectivity through third party companies, we will not be held responsible for such costs.

 

15. Intellectual property

The content of this Website is trademarked, copyrighted and database protected. You agree that the materials you see and the content that is delivered is a part of this Website and shall remain the property of Hot Pottery and/or our licensors.

You are able to display the content of this Website on a computer screen, store content from this Website in electronic form, (for example save the domain for future and easy, accessible use). No content can be stored on any networking driver such as a server or any other device that is connected to a network.

You are able to print one copy of content of this Website for your own personal use; this must not be commercially used. It is agreed that all of the copyright and intellectual notices are kept attached, apart from this you are not able to: reproduce, modify or copy. You may not distribute for the use of commercial use, any other materials or content on this Website.

 

16. Limitations

You may not use this Website for any of the following:

Unlawful, abusive, threatening, vulgar, harmful or obscene material.

Sharing material that encourages usage of a criminal nature, resulting in a civil liability or otherwise breaches any relevant laws, regulations or code of practice.

Accessing computers illegally.

Disrupting other users’ enjoyment of this Website.

Breach of laws where public telecommunications are concerned.

Interfering / disrupting networks, websites connected to this Website.

Storing electronic equipment without permission from the owner.

Availability of this Website

Although we hope that this Website is always running constantly for everyone, we cannot always promise that this Website will always work as we intend it to work. If you do experience difficulties, please contact us with all relevant details of the fault or issue you are experiencing.

If we fail to comply with these Terms and Conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the Contract was made, both we and you knew it might happen.

We only supply Our Products for domestic and private use. If you use Our Products for any commercial, business or resale purpose, we will have no liability to you for any loss of profit, loss of business, loss of anticipated savings, business interruption or loss of business opportunity.

We will not be liable to you for special or punitive damages that may apply to the usage of this Website.

We are not responsible for any risks generally associated with the internet.

Although we try to make sure that all of the content on this Website is correct and accurate as at the present date, sometimes this may not be the case and we will not be liable for such errors.

We are not liable to you in connection with any of the following:

If this Website is incompatible with your device.

Technical errors that may occur, such as: interruptions and faults.

Unreliable, unsuitable or inaccurate website content.

This Website not being able to meet your demand.

Nothing in these Terms and Conditions in any way exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation or any matter for which we may not exclude or limit our liability under any applicable law.

 

17. Right to cancel/suspend your User Account

We may cancel or suspend your User Account with us at any time if you breach any of these Terms and Conditions or our Cookies and Privacy Policy.

You can cancel your User Account with us at any time by informing us via writing. Doing this will also have to comply with you ceasing to use this Website when/after cancellation is posted.

The cancellation or the suspension of your User Account will not affect either your or our rights or liabilities where those rights and liabilities have arisen before such cancellation or suspension.

 

18. Third Party Website

We have no responsibility for any third-party websites that you may enter via this Website, nor do we take liability for the World Wide Web. The content and materials accessed outside this Website are beyond our control.

 

19. Advertisers and Sponsors

Advertisers and sponsors that appear on this Website are of no responsibility Hot Pottery. These sponsors and advertisers submit information at their own liability. We are not liable for any inaccuracy or errors in their promotions.

 

20. Contact Details and Communications

Applicable laws require that some of the information or communications we send to you should be in writing. When using this Website, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on this Website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

All notices given by you to us must be given by email at hello@hotpottery.co.uk. We may give notice to you at either the email or postal address you provide to us when placing your order or in the case of a Registered User, the email or postal address stored in your User Account. Notice will be deemed received and properly served immediately when posted on this Website, 24 hours after an email leaves the sender’s email server, or three days after posting a letter.

21. Events Outside Our Control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (a "Force Majeure Event"). This includes any act, event, non-happening, omission or accident beyond our reasonable control and includes (but is not limited to) the following:

Strikes, lockouts or other industrial action

Fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster

Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport

Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (declared or not) or threat or preparation of war

Impossibility of the use of public or private telecommunications networks

The acts, decrees, legislation, regulations or restrictions of any government

Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use all reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.

 

22. Defective GoodsWe are confident in our product quality but if for any reason you receive any Ordered Products which are defective you must inform us immediately. If any Ordered Products are defective, we will replace and re-arrange delivery of replacement Ordered Products. Your statutory rights will not be affected.

 

 

23. Special Offers

From time to time we may have special offers available, we hold all of the rights to remove and add these special offers when we see fit without any prior notice and we reserve the right to impose specific rules in respect of any such special offer which will be additional terms and conditions which will be applicable to a particular special offer. If a special offer does apply to your Order, then any such rule will apply to any Contract formed in relation to your Order in addition to these Terms and Conditions and our Policies. We reserve the rights to offer, in our complete discretion, different offers to different customers at different times.

 

 

24. Prices

The prices that you see on this Website include VAT. We will always aim to keep our prices up to date. We understand that errors may occur on this Website, in this case we will aim to correct the mistake as soon as possible.

 

25. Free gifts and Promotions

From time to time, free gifts or other promotional incentives (for example a discount on the price payable on certain of Our Products) may be offered to customers who place Orders that meet certain eligibility criteria. Such free gifts and promotional offers are offered on a conditional basis. In the event of an Order which qualified you for such a free gift or promotional offer being cancelled or returned, any free gift provided must also be returned and we reserve the right to charge you for any benefit of any promotional offer received by you in respect of such Order.

 

26. Data Protection Statement

We will only use or hold your personal information if you have given us permission. If you do place an Order with us, this is verification of you doing so.

The personal information that you do agree to us holding will be continually updated and will be destroyed when the reason for its collection in the first place has ceased to exist. The personal data that you have provided will only be passed to third parties that contribute to delivering the service you have committed to, examples of such being our warehouse function and our courier services. They will only be able to use this information to complete their part of the process for you.

Privacy is something that we always respect and we are committed to protecting your information at all times.

27. Entire Agreement

These Terms and Conditions, our Rules and Policies and, if applicable, your Order are an agreement between you and us. They form the entire basis of our relationship. You may not transfer, assign, charge or otherwise dispose of any Contract, or any of your rights or obligations arising under it, without our prior written consent.

 

28. Other Important Terms

Nothing in these Terms and Conditions shall affect your rights as a consumer under the applicable law in the jurisdiction in which you are resident.

We may transfer our rights and obligations under the Contract to another organisation. We will tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the Contract.

Each Contract is between you and us. No other person shall have any rights to enforce any of its terms.

Each of the paragraphs of these Terms and Conditions and each of the Rules and Policies operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

If we fail to insist that you perform any of your obligations under these Terms and Conditions or any of the Rules and Policies, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

Please note that these Terms and Conditions are governed by English law. If you are a consumer, this means each Contract for the purchase of Our Products and any dispute or claim arising out of or in connection with it will be governed by English law, except that if you are not resident in England then English law shall apply only to the extent that it does not override any mandatory laws of the country in which you have your usual place of residence.

In respect of any dispute or claim relating to a Contract, if you are a consumer you and we both submit to the non-exclusive jurisdiction of the courts of England and Wales, but nothing in this clause shall limit your legal rights to bring actions against us or to require proceedings to take place in the country in which you have your usual place of residence. If you are not a consumer, you and we both submit to the exclusive jurisdiction of the courts of England and Wales.

Returns Policy

General

These rules are the returns policy from time to time operated by Hot Pottery (the “Returns Policy”).

These rules are supplemental to the Terms and Conditions of this Website (the “Website Terms and Conditions”) which can be found here and the other Rules and Policies referred to in the Website Terms and Conditions. Unless from the context it is obvious that an alternative meaning applies, all words and phrases given a defined meaning in the Website Terms and Conditions have the same meaning in these rules.

 

Returns Policy

We hope that you absolutely love every purchase made from us, but if you wish to return an item, please email us within 24 hours of receiving your order at hello@hotpottery.co.uk. Items that you wish to return must be sent back within 14 days of receiving the items. To be eligible for a return, your item must be unused and in the same condition that you received it with tags and/or stickers and it must also be returned in the original packaging. Please provide photos. 

You must also provide recipe/proof of purchase. 


You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

When shipping an item, you should consider using a trackable shipping service and purchasing shipping insurance. We don’t guarantee that we will receive your returned item and we cant guarantee the item will arrive undamaged as all items are breakable. 

We reserve the right to refuse any returns or exchange request that does not meet the Hot Pottery  returns requirements.

Sale items (if applicable)
Unfortunately sale items cannot be refunded.

 

Refunds (if applicable) 
Once your return has been received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. 

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Exchanges (if applicable)
We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at hello@hotpottery.co.uk

 

Broken or Faulty Items (if applicable)
If you believe your item is faulty please contact hello@hotpottery.co.uk immediately. When emailing please include a photograph of the damaged/faulty item, and a description of the fault. Please do not attempt to fix the item of your own accord or via a third party as this may affect your entitlement to a refund, compensation or reimbursement.

All items must be checked upon receipt of delivery. If there are any breakages, defects or discrepancies please notify us within 24 hours. We are unable to replace or refund items if we are not notified within this time. We will arrange collection of the faulty item from you and cover the delivery cost of the replacement to make sure you're happy.
